PROFESSIONAL AND ETHICAL DILEMMAS IN LITIGATION

RECORDED MARCH 28, 2012

Archived Webcast

CLE Hours:
6 CLE Hours including 2 Ethics Hour, 1 Professionalism Hour and 3 Trial Practice Hours

About the Seminar:
This seminar will consist of four panels that will consider a series of hypothetical situations which often arise in litigation. Each hypothetical will address at least one ethical, professional or legal dilemma which a litigator may face while representing a client. (A few examples: How soon must you disclose to a client that you have made an error? Can you threaten a bar complaint to obtain leverage in a civil suit? Can your fee agreement limit the time within which a client may dispute an invoice? If you find an important internal memo drafted by your opposing counsel, can you read it and use it? Must you return it?)

The panels will consist of appellate judges (Supreme Court and Court of Appeals), trial court judges, lawyers from the Office of the General Counsel of the State Bar of Georgia, and experienced litigation attorneys. Attendees will be encouraged to participate in the discussions. Georgia’s New Rules of Professional Conduct will be discussed and applied to the hypotheticals.
